California Pawnbroker Convention

At a recent California Pawnbroker convention, we had several dealers approach us with the same issue. Can we help them comply with the newly passed Bill No. 1384 for Firearm Dealers. Specifically, Section 2 ,26806 added to the Penal Code which mandates that on January 1,2024 recording devices must:

1) Retain recordings for 1 year.

2) Be set to record at full motion,15 FPS.

3) Recording devices must be secured and have limited accessibility.

4) The system shall be equipped with a failure notification system.

5) A licensee shall, on an annual basis, provide certification that the recording system is in working order.

6) All areas where firearms are showcased and sold, high quality video and audio recordings with the correct time and date stamp displayed.

Also mandated, on 07/01/2023 a license shall carry a general liability insurance policy of at least one million dollars of coverage per incident.

Upon researching we discovered that California has some of the strictest gun laws in the United States. In just the past few years laws and amendments related to the sale and possession of firearms have been passed. These laws were passed to protect Californians from gun violence and to improve public safety.

Effective July 1, 2023
Assembly Bill No. 1594 Which among other covenants allows for attorneys to bring civil action against a firearm industry member for a violation of the standard on conduct where awards of relief, damage and attorney fees will be assessed. The same right was given to individuals and business owners who received damages stemming from the violation.
